These Community Guidelines form an integral part of the Terms and Conditions governing the use of MakeClub and are binding on all users. Their purpose is to guarantee a safe, respectful and trustworthy environment for the entire community.
1. Permitted conduct
MakeClub promotes a positive environment for coexistence. All users are expected to:
- Treat the rest of the community members with respect and courtesy.
- Provide truthful and up-to-date information in their profiles and posts.
- Use the platform lawfully and in accordance with its purpose.
- Report in good faith any content or conduct that violates these Guidelines.
2. Prohibited conduct
Any of the following conduct is expressly prohibited on MakeClub:
- Publishing offensive, discriminatory, violent, sexually explicit or hate-inciting content.
- Harassing, threatening, intimidating or bullying other users.
- Sending spam, unauthorized advertising or unsolicited repetitive content.
- Impersonating another person, entity or organization.
- Sharing third parties’ personal data without their consent.
- Carrying out fraudulent activities, scams or deception of any kind.
- Infringing third parties’ intellectual or industrial property rights.
3. Content reporting and takedown procedure (DSA)
In compliance with Regulation (EU) 2022/2065 on Digital Services (DSA), MakeClub establishes the following mechanisms for the reporting and removal of illegal content or content contrary to these Guidelines.
3.1. How to report
Users can report content through:
- The report button available on the platform itself next to each piece of content or profile.
- An email sent to legal@makeclub.app, describing the reported content and the reasons for the report.
3.2. What happens after a report
Once a report is received, MakeClub will proceed as follows:
- The moderation team will analyze the reported content diligently.
- Depending on the analysis, the following measures may be adopted: content review, limitation of visibility, removal of content or the application of sanctions to the offending user.
MakeClub reserves the right to act without prior notice when the content poses an immediate risk to community safety or infringes current law.
3.3. Appeal against moderation decisions
Users affected by a moderation decision have 14 days to submit an appeal. The appeal must be sent by email to legal@makeclub.app with the subject line "Moderation appeal", including a detailed description of the reasons why the decision is considered incorrect.
4. Sanctions regime
Failure to comply with these Guidelines may lead to the application of the following sanctions, on a gradual and proportionate basis:
- Formal warning: notification to the user about the infringing conduct and a request for correction.
- Temporary suspension: temporary restriction of access to the platform or to certain features.
- Permanent expulsion: permanent cancellation of the account and prohibition of access to the platform.
All sanction decisions will be reasoned and communicated to the user concerned. MakeClub reserves the right to inform the competent authorities of any activity that may constitute a criminal or administrative offense.
5. Consequences of expulsion
Permanent expulsion from the platform entails:
- Immediate and irrevocable cancellation of access to the account and all MakeClub features.
- Loss of all features, content and data associated with the account.
- Prohibition on creating new accounts on the platform.
6. Refund policy in case of sanction
In the event of expulsion due to non-compliance with these Guidelines, no refunds will be made for paid services purchased, in accordance with article 103.a) of Royal Legislative Decree 1/2007 (TRLGDCU).
However, in exceptional circumstances, MakeClub may assess each case individually. Consumer rights will remain fully protected in those cases where the sanction does not derive from a contractual breach by the user.
7. Security and review of communications between users
MakeClub uses TLS encryption in transit and protection measures at rest to safeguard communications between users.
Access to the content of communications between users will be limited and will only take place in the following cases:
- Investigation of reports submitted by other users.
- Detection of abuse, fraud or spam through automated systems or manual review.
- Compliance with legal obligations or requests from competent authorities.
Access will be restricted to authorized personnel, subject to confidentiality obligations.
8. Amendment of the Guidelines
MakeClub reserves the right to update these Community Guidelines. Material changes will be communicated to users with at least 15 days’ prior notice through the platform or by email.
