1. Acceptance
Access to and use of the MakeClub platform, whether through the mobile app or the website makeclub.app, implies full and unreserved acceptance of these Terms and Conditions, as well as the Legal Notice, the Privacy Policy and the Community Guidelines.
If you do not agree with any of these conditions, please leave the platform and do not use our services.
2. Description of the service
MakeClub is a map-based social platform that connects players, coaches, clubs, agents and other profiles involved in semi-professional, women’s, youth and amateur football.
The platform uses filtering criteria such as geographic proximity, activity, popularity and relevance to show results and recommendations to users.
The "Verified" badge indicates that a profile has completed an identity verification process provided by MakeClub. This badge does not constitute an endorsement or guarantee of the abilities, conduct or reliability of the verified user.
3. Registration and user account
To use MakeClub’s features, you must create a user account. By registering, you agree to:
- Provide truthful, complete and up-to-date information during the registration process.
- Keep your login credentials (email address and password) confidential.
- Immediately notify MakeClub of any unauthorized use of your account at legal@makeclub.app.
MakeClub reserves the right to suspend or delete accounts that breach these Terms or the Community Guidelines.
4. Account cancellation by the user
You may delete your account at any time from the app settings or by sending a request to legal@makeclub.app. Cancellation has the following consequences:
- Immediate cancellation of access to the platform.
- Deletion of your personal data within a maximum period of 30 days, unless legal retention is required.
- Anonymized content you have generated may remain on the platform to maintain the integrity of the service.
- No refunds will be issued for active verifications at the time of cancellation.
- Legal obligations arising from prior use of the platform will not be affected by cancellation.
5. User obligations
When using MakeClub, you agree to use the platform lawfully, diligently and respectfully. In particular, you undertake to:
- Not publish false, defamatory, obscene or unlawful content.
- Not impersonate other people or entities.
- Not use bots, scrapers or automated systems to access the platform or extract data.
- Not infringe the intellectual or industrial property rights of third parties.
- Respect the Community Guidelines at all times.
6. Minors
Use of MakeClub is restricted to people over 16 years of age. Minors under 16 may only use the platform with the verifiable consent of their parents or legal guardians.
MakeClub reserves the right to verify users’ ages and to suspend or delete accounts that do not meet this requirement.
7. Purchases and verification
MakeClub may offer premium features through one-time annual verification payments. The specific conditions of each verification will be detailed at the time of purchase.
In accordance with article 103.a) of Royal Legislative Decree 1/2007 (TRLGDCU), users have 14 calendar days from contracting the service to exercise their right of withdrawal, unless the service has been fully performed with their express consent.
Verification is valid for 1 year from the date of purchase and is not renewed automatically. At the end of the period, the user may choose voluntarily to renew it.
8. Email communications
MakeClub may send email communications to users, distinguishing between:
- Transactional communications: related to account management, security, changes to the service conditions or legal obligations. These communications do not require prior consent.
- Commercial or promotional communications: require the user’s explicit consent, which may be withdrawn at any time through account settings or the unsubscribe link included in each communication.
9. Modification and cancellation of the service
MakeClub reserves the right to modify, suspend or cancel, in whole or in part, the platform’s features at any time and without prior notice, without this giving rise to any right to compensation, except as provided by consumer protection regulations.
10. Limitation of liability
MakeClub shall not be liable for indirect, incidental, special or consequential damages that may arise from the use of, or inability to use, the platform.
MakeClub is not responsible for the interactions, agreements or relationships that users establish with each other outside the platform.
11. Amendment of the Terms and severability
MakeClub reserves the right to amend these Terms and Conditions. Material changes will be communicated to users with at least 15 days’ prior notice through the platform or by email.
If any clause of these Terms is declared null or unenforceable, the remaining clauses shall remain fully valid and effective.
12. Applicable law and jurisdiction
These Terms and Conditions are governed by current Spanish law. For the resolution of any dispute, the courts and tribunals of the consumer’s place of residence shall have jurisdiction, in accordance with consumer and user protection regulations. Likewise, in Spain, the user may refer the matter to Consumer Arbitration Boards or other competent consumer bodies.
